1. Introduction and Scope

These User Terms (“Terms”) govern the terms of use for the online English education services offered by Target English Academy (“Institution”). www.targetenglishacademy.com.tr Each person who visits the website named alan, creates an account and/or uses the service (“USER” or “STUDENT”) declares that they have read, understood and accepted these Terms.

2. Definition of the Service

The institution provides online foreign language education in a digital environment (through Zoom and similar platforms) determined by the institution regarding the program, content, day, time, and teachers. The student agrees to participate in the training program of their choice in accordance with the information provided to them and to pay the contractual fee.

The institution reserves the right to make changes in the teaching staff as deemed necessary.

3. Registration and Training Standards

The student may, during registration, take a free level assessment exam at a date determined by the institution to determine the class in which they will be placed.

Group classes consist of at least 4 and a maximum of 8 people. Since the total class hours may vary depending on the training content, the relevant class hours will be notified to the STUDENT before registration. A class hour is 60 minutes.

The STUDENT accepts the accuracy of the attendance records kept by the teacher. Classes that are not attended for any reason are considered to have been taken; no compensation or refund will be given for these classes.

A 5% discount is applied if the student purchases a new education package after receiving the previous one.

4. One-to-One and Private Lessons

One-on-one private tutoring programs are provided in classes of up to 2 students. The class days and times are determined by mutual agreement between the STUDENT and the institution and can be changed at the mutual request of the parties.

In cases of cancellations not reported at least 24 hours before the class start time, the class is considered taken. In the case of an increase in the class time in private lessons, the fee is calculated based on the cost of a class hour in the institution’s standard program.

5. Payment and Pricing

The tuition fee is paid via credit card or bank transfer to the KURUM bank account using the methods specified on the KURUM website. The STUDENT cannot attend classes until the payment is completed.

The exchange rate price valid at the date the contract is signed is taken into account in course hours cancellations and fee calculations.

6. Cancellation, Termination and Return of Registration

The STUDENT may cancel their registration within the first 2 hours of the course starting without giving any reason. In this case, the STUDENT is responsible for paying the fee for the courses they have taken and the price of the course book or other materials provided to them free of charge.

In case of cancellations made after this period, the STUDENT is responsible for the full cost of the training package they purchased, regardless of the stage of the training they are in.

Refunds for payments made with a credit card are processed as much as possible through the cancellation of the credit card transaction. Non-refundable bank commissions, financing and bank loan fees, and taxes may be charged from the STUDENT.

If there are gift packages offered as part of the campaign along with the educational package, the fee is charged based on the main package purchased. Gift packages cannot be transferred and no refunds will be given for them.

7. Registration Freeze and Transfer

STUDENTS who purchase more than one training package can only request the suspension of registration at the beginning of the new term and upon written application. There is no right to suspend registration in ongoing training packages.

The STUDENT who freezes the registration is obliged to resume the education within 6 months. The STUDENT who does not continue the education during this period accepts that he/she has lost the remaining education rights. The institution aims to start the education for the STUDENT who submits a written application to resume within a suitable date and no later than 3 months.

Payments remaining during the registration freeze period continue to be made on the agreed due dates. In the event of any changes to the tuition fees, the STUDENT has the right to receive education equivalent to the number of hours of classes paid for.

The student may transfer the right to education to a third party under the same conditions provided that he/she has paid the full cost of the education. The transferee cannot transfer this right to another person.

8. Personal Information, Personal Data and Images

The STUDENT agrees that the name, surname, address, contact information, and other personal information provided during registration are accurate and up-to-date. The STUDENT who does not notify the INSTITUTE in writing of any changes to their address or contact information agrees that notifications made to their previous contact information will be considered as made to them.

The institution processes personal data within the scope of the Personal Data Protection Law No. 6698 (“KVKK”) for the purposes of planning and conducting education, establishing contact with the STUDENT, documenting participation, issuing certificates, issuing invoices, and fulfilling legal obligations, and stores them for a period of 5 years.

Personal data may be shared with third parties such as accounting firms and authorized public institutions only in mandatory cases and for the purpose specified therein. The Company takes necessary security measures to ensure that personal data and visual content are not shared in an unlawful manner.

Photography or video recording may be taken during the training. The use of visuals that identify the student in social media, websites, printed or digital promotional materials is subject to the written consent of the student. The student may apply in writing to the institution’s contact address to exercise their rights under the KVKK.

9. Intellectual Property Rights

The training materials, content, videos, lecture notes, and all other resources provided by the institution are protected by intellectual property rights. The STUDENT may not reproduce, distribute, share, or use these materials for commercial purposes without the written permission of the institution.

10. Distance Contract and Electronic Confirmation

These Terms and the registration relationship can also be considered as a distance contract depending on its nature. In matters not regulated in the Terms, the relevant provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation apply.

If the parties reach an agreement through communication tools, the contract will be sent to the STUDENT’s e-mail address or WhatsApp number, and the STUDENT’s confirmation of “I accept the terms of the contract” from the same channel will mean that the contract has been accepted.

11. Responsibility Limit

KURUM shall not be held liable for technical malfunctions, internet connection problems, interruptions caused by third-party digital platforms, or any other problems that may occur due to force majeure. KURUM reserves the right to make reasonable changes to the content, program, or teacher staff of the service.

12. Legal Follow-up and Competent Court

If the STUDENT fails to make any of the payments he/she has committed to in a timely manner, the remaining installments become due and legal proceedings may be initiated. In this case, the STUDENT may be liable for the unpaid education fee, applicable legal interest, execution fees and costs, and attorney fees.

In the event that the educational fee is collected as a result of legal proceedings, the right of the STUDENT to receive education arises for courses for which the fee has been collected but not yet paid. This right must, however, be used within 6 months.

The Mersin Courts and Executive Departments are competent in disputes between the parties.

13th Period

These Terms apply to the relevant training period for which registration has been made. If the training continues or a new training package is purchased, the INSTITUTE may implement a new registration or contract process if deemed necessary.
